Supreme Court rework
Proposal for the Reform of the Supreme Court
I propose reforming the Supreme Court as follows:
Composition: The Supreme Court shall consist of a minimum of ten judges.
Assignment of Judges: Each case shall be assigned to a panel of five judges. Judges who hold an account in the country concerned shall be ineligible for assignment to cases involving that country. Furthermore, judges who have recently deliberated on a case concerning the same country shall receive lower priority when being selected for subsequent cases involving that country.
Career Points System: Judges who fail to cast their votes shall lose career points, while those who demonstrate high-quality roleplay and fulfil their judicial duties effectively shall be rewarded with additional career points.
Presiding Judge: The judge with the highest number of career points shall serve as the presiding judge of the panel. In the event of a tie, the presiding judge shall hold the deciding vote.
Deliberation Period: The time allocated for deliberation shall be doubled to allow judges sufficient time to assess the arguments, examine the evidence, and reach well-founded decisions.
Expanded Judicial Powers: The Supreme Court shall be granted additional powers to ensure that it can effectively enforce the remedies and demands set out in the petitum of each case. These powers shall include the authority to sentence members of the government to imprisonment when warranted by the circumstances of the case. Such a decision shall require the approval of at least 80% of the panel's members, equivalent to four out of five judges.
Judicial Recusal and Challenges for Bias: Parties involved in judicial proceedings shall be entitled to challenge the impartiality of a judge by initiating a special case specifically addressing the alleged bias. This procedure shall allow the Court to assess whether the judge in question has a conflict of interest or has demonstrated partiality that could compromise the fairness of the proceedings. Appropriate measures shall be taken where bias is established, including the potential removal of the judge from the case and their replacement.
Constitutional Amendments and Expedited Judicial Review: When a case concerns a constitutional amendment, the Supreme Court shall be empowered to prevent amendments proposed or pursued in bad faith, particularly where they seek to undermine constitutional principles or manipulate the legal framework for improper purposes. However, where a proposed constitutional amendment is unrelated to the subject matter of the case under consideration, the Court shall be empowered to expedite its review and lift any unjustified blockage, allowing the amendment process to proceed without unnecessary delay.
These reforms aim to strengthen the Supreme Court's institutional effectiveness, guarantee greater impartiality in judicial proceedings, incentivise high-quality judicial roleplay, expand the Court's enforcement powers, and prevent the abuse of constitutional procedures while ensuring that legitimate reforms are not unnecessarily obstructed.
